1. Acceptance of Terms

Nano Banana Pro provides AI-powered image generation, editing, and related tools. Features, models, output quality, speed, and availability may change without notice. We do not guarantee uninterrupted or error-free operation.

5. Acceptable Use

You agree not to use the Services to:

• Generate, upload, or distribute illegal, harmful, harassing, defamatory, obscene, or infringing content.
• Violate intellectual property, privacy, or publicity rights of any person or entity.
• Create deepfakes, non-consensual intimate imagery, or misleading content intended to deceive.
• Attempt to reverse engineer, scrape, overload, or disrupt the Services or underlying systems.
• Circumvent usage limits, access controls, or payment requirements.
• Use outputs in regulated contexts (medical, legal, financial advice, etc.) without appropriate human review and compliance.

6. User Content & Generated Outputs

You retain ownership of content you upload, subject to the licenses below. You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your content solely to operate and improve the Services.

Subject to applicable law and your compliance with these Terms, you may use AI-generated outputs for personal or commercial purposes, except where prohibited by third-party model terms or applicable regulations. You are solely responsible for evaluating whether an output is suitable for your intended use and for obtaining any required rights or consents.

7. Intellectual Property

The Services, including software, branding, documentation, and website content (excluding your content and outputs), are owned by us or our licensors and protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

8. Third-Party Services

The Services may integrate with or link to third-party platforms, AI models, payment processors, or websites. We are not responsible for third-party terms, policies, or practices. Your use of third-party services is at your own risk.

9. Fees & Subscriptions

Certain features may require payment. Prices, plans, and billing cycles are displayed at the time of purchase. Fees are non-refundable except where required by law or explicitly stated otherwise. We may change pricing with reasonable notice for future billing periods.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS. WE DO NOT WARRANT THAT OUTPUTS WILL BE UNIQUE, ERROR-FREE, OR SUITABLE FOR ANY SPECIFIC PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold harmless Nano Banana Pro and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

13. Suspension & Termination

We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms or pose a risk to the Services or other users. You may stop using the Services at any time. Provisions that by nature should survive termination will remain in effect.

14. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Material changes may also be communicated through the Services or by email. Continued use after changes take effect constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise. Any dispute shall be resolved in the courts of Hong Kong SAR, unless applicable law requires a different forum.
